Bohling\" align=\"right\" border=\"0\" \/><\/p>\n<p>Judge Bohling began his legal career in 1968 as an trial attorney for the United States Department of Justice in Washington, D.C., assigned to the Antitrust Division\u2019s Patent Unit. From 1971 to 1973, he was a litigation associate with the law firm of Jones Waldo Holbrook and McDonough in Salt Lake City.<\/p>\n<p>He left law practice in 1973 to join the law faculty of Texas Tech University School of Law in Lubbock, Texas as an assistant professor. After two years, he advanced to an associate professor with tenure, teaching antitrust, business torts, contracts and economic regulation.<\/p>\n<p>In 1979, he returned to Jones Waldo as a shareholder where he remained as a commercial litigator for 14 years. In 1993 he was recognized by the Utah State Bar as the Distinguished Lawyer of the Year. In the same year, he joined federal bench and private mediation panels, and later in the year, was appointed to the Utah Third District Court bench as a general jurisdiction trial judge.<\/p>\n<p>In 2001 Bohling and a team of stake holders, instituted the first mental health court in the state of Utah. It was among the first in the nation. Offered as an alternative to incarceration, its objective was to help find housing and provide treatment, supervision, accountability and a sense of community to mentally ill offenders. The program was a success. Though always constrained by limited resources, similar courts have been established throughout the state and in many other states of the nation.<\/p>\n<p>While serving on the bench, Bohling chaired the Judicial Council\u2019s committee on alternate dispute resolution, where he became a mediation advocate to both the bench and bar. He retired from the bench in 2004 and in the same year was honored by the Utah State Bar as the Judge of the Year.<\/p>\n<p>Upon his retirement, he began his professional mediation practice. While on the bench and in the early years of his practice, he completed mediation trainings at CDR Associates (Boulder, Colorado), Harvard Negotiation Insight Initiative (Harvard Law School) and the Straus Institute (Pepperdine University School of Law). In his 17 year mediation practice, his mediation firm has received a US News\/Best Lawyer Tier 1 ranking. Also, since 2008 Bohling has been listed annually in both Best Lawyers in America and Mountain States Super Lawyers. In 2008 he was inducted into the International Academy of Mediators as a Distinguished Fellow. He has been recognized as Best Lawyers\u2019 Salt Lake City 2013, 2017, 2019 and most recently 2021 Mediation Lawyer of the Year.<\/p>\n<p>Judge Bohling has been a speaker and trainer of negotiation and mediation topics before numerous organizations including the International Academy of Mediators, the American Bar Association (Section of Dispute Resolution), Federal Bar Association (Utah Chapter), J. Reuben Clark (BYU) Law School, Utah Council on Conflict Resolution, Utah State Courts, and the Utah State Bar.<\/p>\n<p>His 40 plus-year legal career includes 3-years at the Department of Justice\u2019s Antitrust Division, 5-years as a law professor, 16-years in private practice, and 11-years on Utah\u2019s district court bench. Judge Bohling was named the Utah State Bar\u2019s <b>1993 Distinguished Lawyer of the Year<\/b> and its <b>2004 Judge of the Year<\/b>.<\/p>\n<p><b>ADR Experience and Qualifications<\/b><\/p>\n<p>Judge Bohling\u2019s mediation training and experience date back to 1993 when he joined US A &amp; M\u2019s mediation panel, and was appointed to the Utah federal district court\u2019s mediation panel. After his appointment to the Utah district court bench, he became the chair of the state judicial council\u2019s ADR committee. For ten years he was actively engaged in promoting mediation in the state and in establishing a court-annexed mediation program. While on the bench he presided over many settlement conferences and informally mediated numerous disputes. He was also the trial judge who presided over <i>State Farm Mutual Insurance Company-v-Campbell,<\/i> 538 U.S. 408 (2003), among other significant civil cases. Since 1993 Judge Bohling has been a student of mediation and has sought out recognized teachers throughout the country.
