Mr. Toth’s perspective as a mediator is informed by nearly thirty years of practice as a trial lawyer in Utah and Texas. During that time, he has tried a variety of tort and business dispute cases to verdict in both state and federal courts. Moreover, his litigation practice has not been limited to “plaintiff” or “defense” representations, which provides him an effective platform to evaluate and discuss the merits and weaknesses of parties’ positions. Mr. Toth believes that mediation is a collaborative process with counsel and that an effective mediation frequently requires the mediator and counsel to address, not only particular legal issues, but the underlying client motivations and emotions driving the dispute.
Mr. Toth’s civil practice has involved commercial disputes, including trade secret, breach of contract, confidentiality and non-solicitation, antitrust and unfair competition, corporate ownership and governance, fraud and breach of fiduciary duty. His civil practice has also included, representing both plaintiffs and defendants, personal injury, complex product liability and medical malpractice claims.
Mr. Toth’s professional experience also helps in communicating with clients and counsel. After law school, Mr. Toth worked for seven years in Houston, Texas with Weil LLP. Upon returning to Utah, he served as Assistant General Counsel to the Salt Lake Olympic Committee for the 2002 Winter Games where he managed a wide range of litigation matters, including trademark enforcement, licensing disputes, construction claims, and wrongful termination claims. After the conclusion of the 2002 Winter Olympics, Mr. Toth returned to private practice with Ray Quinney & Nebeker, P.C., representing a wide range of clients, from Utah’s largest private and publicly held companies, as well as individuals and small businesses.
